TERMS AND CONDITIONS FOR STALLHOLDERS ATTENDING Curated in Cupar Market RUN BY MARKETS BETWEEN TWO FIRTHS LTD

Introduction 

1. These terms and conditions apply to all stallholders attending the Curated in Cupar Market at the Cupar Corn Exchange (operated by Markets Between Two Firths Ltd, hereinafter “MBTF”) from September 2025 (the “Market”). 

1.1 By booking a pitch at the Market, the stallholder agrees to be bound by these terms and conditions. 

Application process, Bookings, Payment and Eligibility 

2. All stallholders are required to submit a completed application form in order to trade at the Market. 

Alongside the application, stallholders must provide the following documents (submitted by email unless otherwise specified): evidence of Public and/or Product Liability insurance (minimum recommended cover £5 million), and any required certificates for electrical equipment (e.g. PAT testing) or other appliances intended for use on site. Stallholders must supply any additional licences, permissions or approvals relevant to their product type prior to trading. Stallholders should provide annual updates of details (including photos) and supply insurance renewal documents as they become available. 

As part of the booking and payment process stallholders must provide emergency contact details (eg a relative or neighbour). 

2.1 The Market does not accommodate food and drink traders. Please do not apply if your primary product is food or drink.  

2.2 The Market is currently full for soap-based products. Applicants in that category should check availability on the application form before applying. 

2.3 Applicants must not be regular monthly stallholders with Markets Between Two Firths at other recurring MBTF events. Priority will be given to new, small businesses and to those who cannot reasonably trade outdoors due to product fragility or weather sensitivity, or where a product category is already covered by a regular stallholder and MBTF seeks to avoid duplication. 

2.4 MBTF will endeavour to minimise duplication of similar products across stalls; where duplication cannot be avoided it will be kept to a minimum. 

2.5 Applications will close when all available spaces are filled or when specific categories reach capacity; category availability will be clearly shown on the application form. 

2.6 You will be notified within 4 weeks of submitting your application whether you have been successful and your booking dates will be confirmed. 

2.7 The attendance fee is £30 per event. This fee covers trading from 10:00–14:00, arrival and set-up from 09:00 and clearing by 15:00. The venue supplies one 6-foot table and one chair. No additional space, extra tables or other furniture may be added by stallholders. 

2.8 Payment deadlines: full payment is due no later than 8 weeks before the event date. A payment link will be issued 2 weeks before that deadline. For November & December events full payment is due no later than 12 weeks before the event date; a payment link will be issued 2 weeks before that deadline. Failure to pay by the relevant deadline will result in cancellation and reallocation of the space.

Cancellation Policy 

3. Where the Market is cancelled by MBTF, or by formal authority instruction (e.g. Council, Fire, Police) or where the venue is declared unsafe or inaccessible, stallholders will be notified as soon as reasonably practicable. MBTF will offer a credit towards a future Market (at MBTF’s discretion). MBTF accepts no liability for any other costs or losses incurred by stallholders in such circumstances. 

3.1 If a stallholder cancels after the relevant payment deadline (8 weeks before, or 12 weeks for November/December events), no refund will be offered. Cancellations made prior to the payment deadline where payment has already been received will, at MBTF’s discretion, be offered a credit towards a future Market in the first instance. 

Adverse Circumstances & Venue Access

3.2 The Market is held indoors in Cupar Corn Exchange. Adverse weather normally does not affect trading; however, if venue access or public safety is compromised (for example due to severe weather, transport disruption, or official directives), MBTF reserves the right to cancel or alter arrangements for the event. In such circumstances stallholders will be informed promptly and MBTF will offer a credit in accordance with clause 3. 

3.3 The market management reserves the right to cancel bookings at any time and for any reason without liability to the stallholder other than refunding or crediting any payment already received for that booking. 

Stallholder Obligations and Market Setup

4. The Market takes place in the downstairs hall of the Cupar Corn Exchange. Trading is 10:00–14:00. Stallholders must be on site in sufficient time to set up from 09:00 and must have cleared and vacated their allocated space by 15:00. 

4.1 The venue supplies one 6-foot table and one chair per booking. All displays, stock and equipment must fit within the allocated footprint. No additional tables, personal furniture or extensions to the allocated space are permitted. 

4.2 Very limited electricity is available in the venue. Any electrical equipment or appliances must be pre-approved and must be accompanied by current certification (eg PAT testing) submitted with the application. MBTF may refuse use of any equipment that it reasonably considers unsafe or unsuitable for the venue. 

4.3 Stall presentation should be professional and inviting. Stallholders should plan displays carefully and ensure that products are presented safely and securely within the allocated space. All items must be stable and not present a risk to the public or neighbouring stalls. 

4.4 Stallholders are responsible for setting up and dismantling their own displays and for ensuring that their stall is safely secured while on site.

4.5 Stallholders are responsible for their own waste and must leave their trading space clean and tidy at the end of the Market. Rubbish must be removed from the venue.

4.6 The sale of food and hot beverages is not permitted at this Market. 

4.7 Stallholders must comply with all applicable laws, regulations and trading standards (including weights & measures), and must hold any licences or approvals required for their products. The stallholder is solely responsible for obtaining and maintaining such licences and approvals; MBTF accepts no liability for breach of licensing or legal requirements by a stallholder. 

4.8 Stallholders must not cause nuisance, annoyance or obstruction and must comply with any reasonable requests made by MBTF or the venue staff. MBTF reserves the right to refuse or withdraw permission to trade if a stallholder’s conduct or presentation is, in MBTF’s reasonable opinion, unsuitable. 

4.9 Smoking: Those who are manning stalls must not smoke within the venue during trading hours. 

4.10 Carrier bags: Stallholders must comply with Scottish carrier bag regulations and any applicable charges. Guidance is available from:

Note: the Market does not permit the use of conventional single-use plastic bags unless they are demonstrably recyclable or biodegradable. 

4.11 MBTF may take photographs or video footage of the Market for promotional purposes. By attending the Market, the stallholder grants MBTF a non-exclusive, royalty-free, perpetual licence to use such images and footage for marketing and promotional activities. 

4.12 Parking: There is no on-site parking at the Corn Exchange. Nearby parking (Fluthers car park) is free of charge; stallholders must ensure they comply with any local parking signage and restrictions. 

Liability 

5. The stallholder shall be responsible for any injury, loss or damage caused to any person or property as a result of their attendance at the Market, including but not limited to their products, equipment, staff or volunteers. 

5.1 The stallholder shall indemnify and keep indemnified MBTF against all claims, damages, losses and expenses (including legal and professional costs) arising from the stallholder’s attendance at the Market, except to the extent that such claims arise from MBTF’s negligence. 

5.2 MBTF shall not be liable for any injury, loss or damage caused to any person or property as a result of a stallholder’s attendance at the Market, except where such injury, loss or damage is caused by MBTF’s negligence. 

5.3 MBTF shall not be liable for any loss of profit, business, revenue, anticipated savings, or any indirect or consequential losses suffered by the stallholder. 

Miscellaneous 

6. These terms and conditions shall be governed by and construed in accordance with the laws of Scotland, and the parties submit to the exclusive jurisdiction of the Scottish courts. 

6.1 These terms and conditions constitute the entire agreement between the stallholder and MBTF and supersede all prior negotiations, understandings and agreements between the parties. No amendment to these terms and conditions will be effective unless it is made in writing and signed by both parties. 

6.2 Any modifications to these terms and conditions will be communicated via email; amendments will require confirmation from both parties where practicable. Continued participation after notice of changes will be taken as acceptance of those changes. 

6.3 If any provision of these terms and conditions is held to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected. 

6.4 No failure or delay by either party in exercising any right, power or remedy under these terms and conditions shall operate as a waiver of that right, power or remedy, nor shall any single or partial exercise of any right, power or remedy preclude any other or further exercise of that right, power or remedy. 

6.5 The stallholder shall not assign or transfer any of their rights or obligations under these terms and conditions without the prior written consent of MBTF. 

6.6 These terms and conditions shall be binding on and enforceable by the parties and their respective successors and permitted assigns. 

6.7 Any notices or other communications required or permitted under these terms and conditions shall be in writing and shall be deemed to have been duly given if delivered personally or sent by email to the addresses specified in the booking form or as subsequently notified in writing by either party to the other. 

6.8 These terms and conditions may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument. 

PRIVACY POLICY 

We understand that privacy is important to our customers and we are committed to protecting the privacy of all personal information we collect and use. This privacy policy outlines our practices regarding the collection, use, and disclosure of personal information in relation to our services.

We collect information from clients in order to provide our services. This includes information such as name, address, email address, phone number, and information about your business. We may also collect payment information for billing purposes.

We will never disclose your personal information to any third party, except as legally required by law eg Environmental Health, Council licensing and official authorities eg Police. We will never sell or rent your personal information to any other party.

We retain your personal information for as long as necessary to provide our services to you and to comply with legal obligations. After this time, we will securely dispose of your personal information. 

Security measures: 

We take the security of your personal information seriously and have implemented appropriate technical and organisational measures to protect it. This includes using secure servers, encryption, and limiting access to your information to authorised personnel only. 

Your rights: 

You have the right to access, correct, and request the deletion of your personal information. You may also withdraw your consent to our use of your personal information at any time. To exercise any of these rights, please contact us by email. 

Changes to this policy: 

We may update this privacy policy from time to time in response to changes in our services or legal requirements. We will notify you of any modifications to this policy by email.

By making a booking, the stallholder agrees to be bound by these terms and conditions. 

The market operator reserves the right to amend these terms and conditions at any time, and any such changes will be communicated to the stallholders via email. Stallholders will be deemed to have accepted the amended terms and conditions if they continue to trade at the market after the changes have been communicated to them.
